1. About these terms

By downloading, installing or using Trophist you agree to these terms. If you do not agree, do not use the app.

Trophist is a free Windows app that shows your Steam library and achievement progress. While a game is running in Trophist, it lets you lock or unlock that game's achievements and save the changes to your Steam account.

Trophist is published by Matúš Gallo, a sole trader registered in the Czech Trade Licensing Register, with a registered place of business at Kaprova 42/14, 110 00 Praha 1, Czech Republic, Company ID (IČO): 22028251 ("we", "us"). The website is trophist.com.

2. Licence and ownership

Trophist is based on Steam Achievement Manager by Rick "gibbed". It is a modified version distributed under the same zlib licence, included with the app as LICENSE.txt. That licence lets you use, copy, change and redistribute the software, provided that:

1. you do not misrepresent the origin of the software;
2. altered versions are plainly marked as such;
3. the licence notice is not removed.

The Trophist name, logo and website content belong to us and are not covered by the zlib licence.

Trophist is not affiliated with, endorsed by or sponsored by Valve Corporation or Steam. Steam and the Steam logo are trademarks of Valve Corporation. Game names, artwork and achievement data shown in the app belong to their respective owners.

3. Your use of Trophist and its risks

You must be at least 16 years old, or have the consent of a parent or legal guardian, to use Trophist.

You may use Trophist only with a Steam account you own and only to change that account's achievements. You remain bound by the Steam Subscriber Agreement and by each game's own terms.

Changing achievements goes against the spirit of some games. Please be aware that:

• games with anti-cheat, leaderboards or online rankings may detect or react to changed achievements;
• a game publisher or Valve may take action against your account, including restrictions or bans;
• unlocking an achievement you have not earned may affect statistics, rewards or rankings in that game;
• changes saved to Steam cannot always be undone.

You use Trophist at your own risk. You are solely responsible for which achievements you change and for any consequences on your Steam account or in any game.

You must not use Trophist to change accounts that are not yours, to gain an unfair advantage in competitive play, or in any way that breaks the law or the rights of others.

4. Updates, third parties and liability

Updates. Trophist checks trophist.com for new versions and installs only releases signed with our release key. We may change, suspend or stop Trophist or its updates at any time, without notice.

Third-party services. Trophist works with the Steam client and loads data and images from Steam and other services (see the Privacy Policy). We do not control those services and are not responsible for their availability, content or changes that stop Trophist from working.

No warranty. Trophist is provided "as is" and "as available", without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that it will be error-free, compatible with every game or always available.

Limitation of liability. To the maximum extent permitted by law, we are not liable for any damages arising from the use of or inability to use Trophist, including loss of data, loss of achievements or progress, and suspension, restriction or ban of a Steam or game account. Nothing in these terms limits liability that cannot be limited under applicable law, such as liability for intent or gross negligence, or your statutory rights as a consumer.

Indemnification. You agree to defend, indemnify and hold us harmless from any claims, damages, losses and costs (including reasonable legal fees) brought by third parties, including Valve or game publishers, that arise from your use of Trophist, your changes to achievements, or your breach of these terms, the Steam Subscriber Agreement or any game's terms, to the extent permitted by applicable law.

5. Changes, governing law and contact

Changes. We may update these terms. The new version is published on trophist.com with a new "Last updated" date. If you keep using Trophist after that, you accept the updated terms.

Ending use. You can stop using Trophist at any time by uninstalling it in Windows Settings → Apps.

Governing law. These terms are governed by the laws of the Czech Republic. Disputes go to the courts of the Czech Republic, unless mandatory consumer protection law in your country of residence gives you other rights. If any part of these terms is found invalid, the rest stays in effect.
